These Terms of Service (“Terms”) govern your access to and use of Unity Bar & Grill’s website, online ordering, event/ticket sales, loyalty or promotions, and other services we provide (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.


1) Eligibility & Account

  • You must be at least 13 to use the Services and 21 to purchase or consume alcohol.

  • You are responsible for your activity and for keeping any account credentials secure.

  • We may refuse, suspend, or terminate any account or order at our discretion (e.g., suspected fraud, policy violations).


2) Orders, Pricing, Taxes & Fees

  • Menu & Pricing. Items, prices, taxes, fees, and availability may change without notice. Photos are illustrative.

  • Errors. We may cancel and refund orders affected by menu, pricing, or availability errors.

  • Payment. You authorize us (and our payment processors) to charge your selected payment method for all purchases, including applicable taxes/fees and gratuities you add.

  • Third-party marketplaces. If you order via Uber Eats, DoorDash, etc., their terms and pricing may differ and govern that transaction.


3) Pick-Up, Delivery & Alcohol

  • Pick-Up. Bring a valid ID and your order confirmation. We may decline order handover if we cannot verify identity.

  • Delivery (where offered). Delivery areas, times, fees, and minimums vary. Orders may be left at door if you select that option; risk of loss passes upon delivery.

  • Alcohol. Alcohol sales are for 21+ only. Valid, scannable government ID is required. We may refuse alcohol sales or pickup/delivery for any reason (e.g., visible intoxication). We do not ship alcohol across state lines and deliver alcohol only where permitted by law. Some orders may require purchase of food with alcohol, as required by local or state laws.


4) Cancellations, Refunds & Guest Recovery

  • Pre-prep cancel. Contact us ASAP; if preparation hasn’t started, we’ll attempt to cancel and refund.

  • After prep. Once preparation begins, cancellations/refunds are limited to our discretion.

  • Order issues. If something is wrong (missing/incorrect/quality concerns), contact us promptly with details and your order number. We may offer a re-make, credit, or partial/full refund at our discretion.

  • Events/Tickets. Unless noted otherwise on the event page, event tickets are non-refundable but may be transferable. If we cancel or materially change an event, we’ll issue a refund or credit.


5) Promotions, Loyalty & Gift Cards

  • Promos. Promotions, coupons, and discounts are subject to terms, may not be combined, and can change or end at any time.

  • Loyalty. If offered, loyalty points have no cash value and may be adjusted for suspected abuse or error.

  • Gift Cards. Gift cards are not reloadable for cash (except as required by law), are not replaceable if lost/stolen, and are redeemable only for eligible purchases at participating locations/channels we specify.


6) User Conduct

You agree not to:

  • Violate laws or these Terms;

  • Misrepresent identity, age, or authorization to receive alcohol;

  • Interfere with or disrupt the Services;

  • Copy, scrape, or reverse engineer the Services;

  • Post or transmit unlawful, infringing, deceptive, or harmful content;

  • Engage in payment or chargeback fraud, coupon abuse, or false claims.

We may investigate and take action, including canceling orders, disabling accounts, and cooperating with law enforcement.


7) User Content & Reviews

  • You may submit reviews, photos, and feedback (“User Content”). You retain ownership of your content.

  • You grant Unity a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content in connection with the Services and our marketing (in any media), subject to applicable laws.

  • Do not submit content you don’t have rights to, or that violates others’ privacy, publicity, or IP rights. We may remove or refuse any content.


8) Intellectual Property

The Services, including text, graphics, logos, menus, photos, and software, are owned by Unity or its licensors and are protected by IP laws. Except as expressly allowed, you may not use, copy, or create derivative works of our content.


9) Communications (Email & SMS)

  • Transactional messages. You may receive order updates, receipts, and essential service communications.

  • Marketing. With your consent, we may send marketing emails/SMS.

  • SMS Terms. Message/data rates may apply. Message frequency varies. Reply STOP to opt out, HELP for help. Consent is not a condition of purchase. See our Privacy Policy for details.


10) Privacy

Our Privacy Policy explains how we collect, use, and share information. By using the Services, you consent to those practices.


11) Accessibility

We aim to make our Services accessible. If you encounter accessibility barriers, please contact info@unitybarandgrill.com and we’ll work to assist.


12) Third-Party Services & Links

We may link to or use third-party services (e.g., delivery platforms, payment processors, social networks). Those services are governed by their own terms and policies. We’re not responsible for third-party sites or services.


13) Disclaimers

AS IS / AS AVAILABLE. To the fullest extent permitted by law, the Services and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, or that defects will be corrected.

Food allergy notice: We handle common allergens. Cross-contact may occur. If you have a severe allergy, please inform us before ordering; we cannot guarantee allergen-free items.


14) Limitation of Liability

To the maximum extent permitted by law, Unity and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits/revenues, arising out of or related to your use of the Services, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid to Unity for the transaction giving rise to the claim in the three (3) months preceding the event.

Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted.


15) Indemnification

You agree to defend, indemnify, and hold harmless Unity and its affiliates, owners, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or laws.


16) Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. It affects your rights.

  • Informal resolution. Contact us first at info@unitybarandgrill.com; most issues can be resolved quickly.

  • Binding arbitration. Except for small-claims matters or claims for injunctive relief, any dispute between you and Unity arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association (AAA).

  • Class-action waiver. You and Unity agree that disputes will be brought only in your or our individual capacity, not as a plaintiff or class member in any class or representative proceeding.

  • Opt-out. You may opt out of arbitration by sending written notice to info@unitybarandgrill.com within 30 days after you first accept these Terms; include your name, contact info, and a clear statement that you opt out.

  • Governing law & venue. These Terms are governed by the laws of the State of Colorado, without regard to conflicts principles. For any disputes not subject to arbitration, exclusive venue lies in the state or federal courts located in El Paso County, Colorado.


17) Changes to the Services or Terms

We may modify the Services or these Terms at any time. The “Effective Date” shows the latest version. Continued use after changes means you accept the updated Terms.


18) Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive termination.


19) Severability & Entire Agreement

If any provision is found unenforceable, it will be severed or limited to the minimum extent necessary; the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any posted offer-specific terms, are the entire agreement between you and Unity regarding the Services.
